Prolifiq Software, Inc. collects, processes, and maintains data in relation to persons from within member states to the European Union ("European data subjects") and Switzerland (“Swiss data subjects”) related to the use of our technology and services in the European Union and Switzerland.

What data does Prolifiq collect and/or process?

Prolifiq provides technology that our clients use to interact with their customers. Our solutions include content management, compliant email, reporting, and communications. In order to enable these capabilities, Prolifiq receives and processes data related to European Swiss data subjects provided to us by our customers.

The data provided to Prolifiq varies by client based on how they are using our tool. Typically clients provide the following types of customer data: country, first name, last name, office street address, city, zip code, professional designation, and email address (as applicable). Clients may also provide Prolifiq with similar data for their employees: country, first name, last name, mailing address, city, zip code, phone number and work email address.

In addition, Prolifiq collects and maintains data related to the consumption of digital content delivered via our application (e.g. open rates, click rates, unsubscribe activity) and accessed via our websites (e.g. date / time of visit, source of visit).

Why does Prolifiq collect and/or process data?

Prolifiq processes data provided by customers for the purpose of enabling Prolifiq’s applications and tools.

The data collected by Prolifiq is used differently depending upon the particular service or product being provided, including: distributing sales and marketing information to data subjects, supplying services and/or products to data subjects, developing and improving our websites, services and products, personalizing our services and products, fraud detection and prevention, compliance with governmental, legislative and regulatory bodies, customer support and relationship management.

In support of these purposes, Prolifiq may access the data defined above to provide services, correct and address technical problems, to respond to a request from a Prolifiq customer who supplied the data, or in response to contractual obligation.

The data provided by our customer and/or collected on their behalf is the property of each respective client. Prolifiq does not share personal information with third-party service providers without the explicit written consent of the Prolifiq customer who submitted the data to Prolifiq. If this practice should change in the future we will update this privacy policy and provide individuals with opt-out choice. 

Prolifiq may be liable for the onward transfer of EU and Swiss individual’s personal data to third parties.

Can I access, limit use, or limit disclosure of my personal information?


European and Swiss data subjects have the right to access personal data about them, and to limit use and disclosure of their personal data. Data subjects (individuals) who believe Prolifiq is handling their personal data may contact us at to review, correct, or edit their information.

Prolifiq employees have limited ability to access data our provided by our customers. Requests to access, limit use, or to limit disclosure, should include the name of the Prolifiq customer who submitted your data to our services. Prolifiq will refer your request to our customer, and support them as needed in responding to your request.

U.S. Federal Trade Commission enforcement:

Prolifiq’s commitments under Privacy Shield are subject to the investigation and enforcement of the United States Federal Trade Commission.

Compelled disclosure:

Prolifiq may be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

How do I make an inquiry or complaint?

If you believe Prolifiq maintains your personal data in one of the services within the scope of our Privacy Shield certification, you may direct any inquiries or complaints concerning our Privacy Shield compliance to Prolifiq will respond within 30 days.

In compliance with the EU-U.S. and Swiss-U.S. Privacy Shield Principles, Prolifiq commits to resolve complaints about your privacy and our collection or use of your personal information. European Union and Swiss individuals with inquiries or complaints regarding this privacy policy should first contact

Prolifiq has further committed to refer unresolved privacy complaints under the EU-U.S. and Swiss-U.S. Privacy Shield Principles to an independent dispute resolution mechanism, the BBB EU PRIVACY SHIELD, operated by the Council of Better Business Bureaus.
